Using Trusts within your will

Following the changes announced by the Labour Government, from April 2027 any wealth contained in personal pensions/Sipps/SSAS's will be added back into the deceased' estate and made subject to Inheritance Tax at 40%.

NOTE: The £ 325,000 threshold has been held in place since 2009/10 and given the rampant inflation over this period the resulting stealth tax or 'fiscal drag' is pulling more families into this tax trap. * This figure does not take into account the Residence Nil Rate Band which may apply in some cases. No Inheritance tax is paid where assets are inherited by a spouse / civil partner (in which case it is the second death where Inheritance Tax will be paid).

In addition anyone inheriting from this source (for example children) will also pay additional income tax at their marginal rate. This could result in total taxes of upto 67% being paid if your estate is worth more than £ 325,000* upon death - considerably more than the rate of tax relief they would have enjoyed when making pension contributions.
